Terms of Service
Effective October 19, 2026
These terms cover your use of annmcdonald.live and any program, membership, service, event or product you register for or buy from us, whether on this site, on another of our sites or platforms, or by invoice. Everything is offered by Vectorworks Media, Inc., a California corporation ("we," "us"), which does business as Ann McDonald, Designed Daily®, Patrick McDonald Official, Brand Crew AI™, The Grounding Path, The Forward Shape, Seasonal Rich, Seasonal Rich Mastery and Stress-Free Holiday Home, among other brands. By using the site, registering for an event or buying from us, you agree to these terms. When you buy on this site, you confirm this by ticking a box at checkout.
Please read section 19 carefully. It requires you and us to resolve disputes through individual arbitration, and it waives class actions and jury trials.
1. Who can buy. You must be 18 or older to buy a program.
2. Our programs. We offer live and recorded programs, memberships, coaching and events, including Money Frequency, SEATED™, SEATED™ Self-Guided, Brand Crew AI™, Seasonal Rich Mastery, VIP Days and private coaching, and free events such as From Polite to Paid™. That list is only a set of examples; these terms apply to everything we offer. Each sales page, invoice or proposal describes what's included, the dates and the price.
Signed agreements. If you sign a separate written agreement with us (for example, for a VIP Day or private coaching), that agreement controls wherever it conflicts with these terms. Everything it doesn't address, including section 19, is governed by these terms.
Live sessions. Live sessions run on Zoom at the times stated, in Pacific time. Dates and times may change; when they do, we'll tell you by email.
3. Payment. Prices are in US dollars. Payments are processed by Stripe; we never see or store your full card number. If you choose a payment plan, you authorize us to charge your card each month until every installment is paid (5 payments for Money Frequency, 3 for SEATED™ Self-Guided). The plan ends on its own after the last payment.
4. Payment plans and monthly memberships. If you choose a payment plan, you are responsible for every installment; the plan is a way to pay the full price, not a monthly subscription you can cancel. If an installment fails, Stripe retries the card. If it still isn't paid within 14 days of our email, we may end your access to the program. Payments already made are not refunded, and the remaining balance stays due.
Monthly memberships, such as Brand Crew AI™, are different: they renew each month at the price shown when you joined until you cancel, and you can cancel anytime. Cancel from your account or by emailing ann@annmcdonald.com; your cancellation stops all future charges, and your access continues to the end of the month you've already paid for. We don't refund partial months. If we ever change a membership's price, we'll email you at least 30 days before the new price applies, so you can cancel first.
5. All sales are final. Our programs are delivered live, with immediate access to members-area materials, so all sales are final. We don't offer refunds, returns or exchanges, including on payment-plan installments. Monthly memberships can be cancelled anytime, as described in section 4, which stops future charges. You confirm this at checkout. Our Refund Policy says the same in one place.
6. Bonus gifts. Some programs come with a bonus gift, such as the Money Frequency supplemental text. A bonus gift is a thank-you, not part of what you pay for. Gifts depend on availability from others, so we can't promise that a gift will be sent, when it will arrive or that it will arrive at all. If a gift isn't available, we may send something else or nothing, and nothing is owed in its place. Gifts have no cash value and can't be returned or exchanged.
7. Members area. Your access code is for you alone. Please don't share it, post it or share recordings or materials. We may change a code at any time, and we'll send current members the new one. Access lasts for the life of the program as described on its sales page.
8. Recordings and your likeness. Live sessions and events are recorded. By joining live or online, you give us permission to record you on audio and video and to use your name, likeness, voice and anything you share in the chat, in recordings shown to other members and in our marketing, in any medium, without payment and without review of the final product. You can keep your camera off and use a first name only.
9. Our content. Everything on the site and in our programs (teachings, workbooks, scripts, meditations, recordings, and names such as Designed Daily®, SEATED™, Polite to Paid™, Money Frequency, Brand Crew AI™, Seasonal Rich and Seasonal Rich Mastery) belongs to Vectorworks Media, Inc. You may use it for your own personal growth. You may not copy, resell, teach or publish it.
10. For entertainment purposes only. Our programs, events and content are for entertainment purposes only. They are not financial, investment, legal, tax, medical or psychological advice, and they are not tailored to your situation. Ann McDonald and Vectorworks Media, Inc. are not licensed financial advisers, investment advisers, brokers, accountants, attorneys or therapists, and no fiduciary relationship arises from your purchase. Consult a licensed professional before acting on anything you learn. Any decisions you make are your own. See our Earnings & Results Disclaimer.
11. No guarantees. We don't promise any specific income, result or outcome. Your results depend on your own effort, circumstances and decisions.
12. Limit of liability. To the fullest extent the law allows, neither of us is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the greater of $100 or the amount you paid us for the program it concerns in the 12 months before the claim arose.
13. Text messages. If you give us your mobile number and opt in, you agree to receive recurring automated text messages from the Ann McDonald | Designed Daily® number (Vectorworks Media, Inc.) at the number you gave: event reminders and join links, program updates, session-day reminders and occasional offers. Consent to texts is never a condition of any purchase. Message frequency varies. Typical frequency: a few texts around each free event you register for, a welcome text when you join a program, and about one text each session day while a program runs (for Money Frequency, one each session Wednesday). Message and data rates may apply. Reply STOP to any message to opt out; we'll send one confirmation and then stop. Reply HELP for help, or email ann@annmcdonald.com. Mobile carriers are not liable for delayed or undelivered messages. Your number and opt-in are handled as described in our Privacy Policy, and are never shared or sold for anyone else's marketing.
14. Your responsibility. You are solely responsible for your own decisions, choices and actions, including anything you do as a result of a program. You accept full responsibility for your personal and business development, your financial situation, and the results of what you choose to do.
15. No warranties. Programs and content are provided "as is." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or any specific result.
16. Indemnification. You agree to indemnify and hold harmless Vectorworks Media, Inc. and its officers from any third-party claim, loss or expense (including reasonable attorneys' fees) arising from your breach of these terms or your misuse of our content.
17. Live sessions and what you share. Please treat every woman in our sessions with respect. What other members share in a session stays there; don't record, screenshot or repeat it. If you send us a testimonial, win or story, you allow us to use it, with your first name, in our marketing. We'll never use it to portray you negatively, and you can ask us to stop using it at any time. We may remove anyone who disrupts a session.
18. Force majeure (events outside our control). We are not responsible for any delay or failure to deliver a session, event or material when it's caused by something beyond our reasonable control, including acts of God and natural disasters, fire, flood or wildfire, pandemics and public-health orders, government restrictions, war, terrorism or civil unrest, strikes, illness or injury, and outages of Zoom, the internet, telephone or power. When that happens, we'll tell you as soon as we can and reschedule the session, provide a recording, or deliver the material another way. Force majeure doesn't pause or cancel payments you've agreed to, including payment-plan installments.
19. Disputes: individual arbitration and class action waiver. Please read this section carefully. It affects your rights.
- Talk to us first. Before bringing any claim, email ann@annmcdonald.com with your name, what happened and what you're asking for, and give us 30 days to resolve it with you directly.
- Binding individual arbitration. Any dispute between you and us that arises from or relates to these terms, the site, or any program, event, purchase, email or text message will be resolved by binding arbitration before a single arbitrator, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. You and we each give up the right to a trial in court and to a jury trial. Hearings take place in Placer County, California, or by video or phone if you prefer; a claim under $10,000 may be decided on written submissions alone. We'll pay all AAA filing, administration and arbitrator fees beyond the amount the AAA's rules require a consumer to pay. Each side pays its own attorneys' fees, unless the arbitrator awards fees under a law that allows it. The arbitration is confidential, and the award may be entered in any court with jurisdiction.
- No class actions. You and we may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative action or arbitration. The arbitrator may not combine more than one person's claims, may not preside over any class or representative proceeding, and may award relief only to the individual party seeking it, and only as far as needed to resolve that party's individual claim.
- Public injunctive relief. If you seek public injunctive relief that California law doesn't allow to be waived, that request alone will be decided by a court in Placer County, California, after the arbitration of your individual claims is finished, and the court case will be paused until then.
- Mass arbitration. If 25 or more similar demands for arbitration are filed against us by or with the help of the same or coordinated lawyers or organizations, they will be administered in batches of up to 25 under the AAA's Mass Arbitration Supplementary Rules, one batch at a time, with fees charged only as each batch proceeds. Any deadline to bring a claim is paused while a demand waits for its batch.
- Exceptions. Either of us may instead bring an individual claim in small-claims court, and either of us may go to court to stop the misuse of our or your intellectual property.
- Your right to opt out. You may opt out of this arbitration agreement by emailing ann@annmcdonald.com with your name and "Arbitration opt-out" in the subject within 30 days of your first purchase or registration. Opting out doesn't affect any other part of these terms.
- If part of this section fails. If the class action waiver is found unenforceable for a claim, that claim (and only that claim) will be decided by a court, not in arbitration, and never as a class arbitration. If any other part of this section is found unenforceable, it will be severed and the rest will still apply.
- Governing law and courts. These terms are governed by California law, without regard to conflict-of-law rules. Anything that isn't arbitrated will be decided by the state or federal courts in Placer County, California, and you and we agree to their jurisdiction.
20. AI tools. Some programs, such as Brand Crew AI™, use artificial intelligence to help you create content. AI can be wrong, incomplete or unoriginal, so review and edit everything it produces before you use or publish it; you are responsible for what you use. What it produces is for entertainment purposes, like everything else we offer, and is not professional advice. You keep the rights you have in what you put in and what you create, and you let us and our technology providers process it to run the tool. Please don't enter anything confidential, or anyone else's personal information without their permission.
21. Links to other sites. Links to other sites, such as Zoom or Stripe, are for your convenience. We don't control those sites and aren't responsible for them.
22. Changes. We may update these terms. The date at the top shows the latest version; changes apply to purchases and registrations made after that date. If any part of these terms is found unenforceable, the rest stays in effect, and our choice not to enforce a term doesn't waive it.
